AN ANALYSIS OF THE OPERATION OF SEPARATION OF POWER IN NIGERIA’S PRESIDENTIAL DEMOCRACY

Abstract

The study examined the operation of separation of power in Nigeria’s presidential democracy. It adopted secondary source of data which include Textbooks, Journals, Magazines, Newspapers and other documentary materials relevant to the study. Separation of power lead to specialisation among the three arms of Government, prevent tyranny and dictatorship in the state and promote rule of law. The problems the study attempts to address are the feud between the Executive and the Legislature on budget issues, the problem of passing bills into laws and delay in court processes which have negative effects on human rights. The study recommended that there should be effective cooperation and partnership between the arms of Government during budget preparation and passage of bills into laws.  1999 constitution should be review in line with the yearnings and aspirations of Nigerians. All arms of Government and Government agencies should adhere strictly to the rule of law. Government should establish more courts and recruit more Judicial officers.
